General Conditions

This website is owned and operated by Orchard Reef Coral Farm LLC. These Terms of Use (“Terms”) govern your use any website where this Terms of Use is posted (each a “Site”) or any mobile application (each an “App”) that are operated by Orchard Reef Coral Farm LLC (herein, “Orchard Reef”, “we” and “us” or “Company”). The Sites and Apps are collectively referred to in these Terms as a “Services.” By using the Services, you agree, without limitation or qualification, to be bound by these Terms and the Company Privacy Policy. If you do not accept these Terms in their entirety, please do not use the Services.

The Company may revise these Terms at any time. Your continued usage of the Services will mean you accept those changes, and you agree to comply with all applicable laws and regulations. The materials provided through the Services are protected by law, including, but not limited to, United States copyright laws and international treaties.

The terms “you,” “your,” “user,” and “users,” as used herein, refer to all individuals and/or entities accessing the Services for any reason.

We provide you with access to and use of the Services subject to your compliance with the Terms. By using these Services you agree to use the Services in a manner consistent with any and all applicable laws and regulations.

Terms of Sale

Because the products we sell are living animals, all sales conducted through this website are final, and we do not accept returns under any conditions. Shipping costs are also not refundable under any conditions. 

We do offer refunds ONLY if a Buyer receives items that are Dead On Arrival (DOA), AND the Buyer documents their condition with the specific photographs described in our DOA Guarantee. Within 48 hours of receiving images documenting DOA items, we will review the images and contact the Buyer with our decision.

If we determine that the images show evidence that the corals were DOA, we will contact the Buyer and offer a replacement or refund depending on (1) the preference of the buyer and (2) the availability of replacements. The Buyer accepts all responsibility for the cost of shipping any replacement items if they choose replacements instead of refunds. 

No refunds will be issued for free items included in the order, or for items sent as replacements following a DOA claim. 

These Terms of Sale supersede any other agreements the Buyer may have with other financial institutions. The Buyer agrees to handle any disputes regarding their order exclusively through the process outlined in this document, and forfeits any right to dispute the sale with payment gateways including Paypal, Stripe, etc.

Shipping Terms

Any items purchased through this Service are shipped through Third-Party Shipping companies including FedEx, UPS, and USPS. The Buyer selects the service, shipping date and shipping time during checkout in our Service, and we agree to ship the order using the selected service on the date requested by the customer either during checkout or during subsequent email communications.

Any delays in shipping by these Third-Party Shippers are outside the control of our Company, and we disclaim any liability for delays in shipping, even if those delays result in damage to the items ordered through our Service. The Buyer agrees not to hold Orchard Reef liable for any delays in shipping.

Disclaimers; Limitation of Liability

All content available on the Services is provided for informational purposes only. The use of the Services or the Contents is at your own risk. The Contents on the Services could include technical inaccuracies or typographical errors. We may make changes or improvements at any time.THE CONTENTS ON THE SERVICES ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE MATERIAL WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OF OR THE RESULT OF THE USE OF THE CONTENTS ON THE SERVICES IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.
